Terms & Conditions

1. Introductory Provisions

These Terms and Conditions (hereinafter the "Terms") govern the rights and obligations between FANTECH Europe s.r.o. (hereinafter the "Seller") and its customers (hereinafter the "Buyer") in the sale and servicing of FANTECH branded laser equipment.

2. Subject of the Contract

Goods and Services: The subject of the contract is the sale and servicing of laser equipment, including accessories and spare parts.

Specification: Details of products and services are provided in the offer or contract.

3. Conclusion of the Contract

Offer: The Seller shall provide the Buyer with an offer that includes specifications, price, and delivery terms.

Acceptance: The contract is concluded upon written confirmation of the offer by the Buyer.

4. Price and Payment Terms

Prices: Prices are stated in the offer and valid for the period indicated therein.

Payment: Payments are made based on invoices issued by the Seller. The Buyer is obliged to pay the invoice within 14 days from the date of issue unless agreed otherwise.

5. Delivery Terms

Delivery Times: Delivery times are stated in the confirmed order or contract.

Receipt of Goods: The Buyer must inspect the goods upon receipt and report any defects within 3 days.

6. Service and Maintenance

Warranty Service: The Seller provides warranty service for manufacturing defects for a period of 24 months.

Post-Warranty Service: The Seller offers post-warranty service by individual agreement.

7. Withdrawal from the Contract

Withdrawal Conditions: The Buyer may withdraw from the contract under the conditions specified in the contract. Withdrawal must be in writing.

8. Complaint Procedure

Filing a Complaint: Complaints must be submitted in writing and include a description of the defect and proof of purchase.

Processing Time: Complaints will be processed within 30 days of receipt.

9. Personal Data Protection

The Seller processes the Buyer's personal data in accordance with applicable legal regulations. The data is used solely for the purposes of fulfilling the contract.

10. Dispute Resolution

Judicial Resolution: Disputes will be resolved by the competent court according to the Seller’s registered office.

Out-of-Court Resolution: The Buyer may use out-of-court dispute resolution via the Czech Trade Inspection Authority.

11. Governing Law

The contractual relationship is governed by the legal system of the Czech Republic, particularly Act No. 89/2012 Coll., the Civil Code, as amended.

12. Final Provisions

These Terms are effective as of January 1, 2024. The Seller reserves the right to amend them. The Buyer will be informed of any changes in an appropriate manner.
